The Authentic Leadership Inventory, Workplace Trust Survey, Flourishing-at-Work Scale, and the Job Demands-Resources Scale were utilized.Main FindingsThe study found that authentic leadership was a significant predictor of flourishing through trust in the leader. Job overload did not moderate the relationship between trust in the leader and employee flourishing.Practical/Managerial ImplicationsThis study emphasizes the potential role of authentic leadership in fostering a trustful relationship between employees and their leaders. It might result in the increased flourishing of employees. The non-significant influence of job overload on trusting relationships in precarious work contexts was also illuminated.Contribution/Value-AddThrough the analysis of these relations, organizations may be favorably equipped to optimize the resources required to improve performance. After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from excessive legalistic influences. (...) According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. The process of ecclesiastical discipline evokes feelings of guilt and shame. Whilst literary study suggested this to be the case, the empirical research confirmed it. It is clear that the three-fold process was a traumatic and shocking experience for ministers. Most upsetting was the way that the process was handled. It was done in a non-professional way and without brotherly or sisterly love. The process triggered guilt and shame emotions in a number of ways, not least by the lack of (...) support and guidance. Respondents indicated that they had positive and negative experiences of guilt and shame during the discipline process. Most respondents took action to amend their mistakes, and thereby used the guilt feeling functionally, whilst the use of defence mechanisms showed that they did not manage and process the feelings of shame. It is unsettling to realise that the Dutch Reformed Church fails her ministers in time of need. Only a few parishioners and ministers from other denominations provided some sort of comfort during the discipline process. The church gave no support and guidance in the processing of the feelings of guilt and shame. The church lacked in every aspect, even to show a basic understanding of the trauma, and none of the church councils offered any basic or interventive help. To remedy the situation, it is proposed that the church should take its task as caregiver during the ecclesiastical discipline of ministers very serious and give guidance in an official and professional way. Introduction While quizzing during informed consent for research to ensure understanding has become commonplace, it is unclear whether the quizzing itself is problematic for potential participants. In this study, we address this issue in a multinational HIV prevention research trial enrolling injection drug users in China and Thailand. Methods Enrolment procedures included an informed consent comprehension quiz. An informed consent survey followed. Results 525 participants completed the informed consent survey (Heng County, China=255, Xinjiang, China=229, Chiang Mai, Thailand=41). Mean age was (...) 33 and mean educational level was 8 yrs. While quizzing was felt to be a good way to determine if a person understands the nature of clinical trial participation (97%) and participants did not generally find the quiz to be problematic, minorities of respondents felt pressured (6%); anxious (5%); bored (5%); minded (5%); and did not find the questions easy (13%). In multivariate analysis, lower educational level was associated with not minding the quizzing (6–10 yrs vs 0–5 yrs: OR=0.27, p=0.03; more than 11 yrs vs 0–5 yrs: OR=0.18, p=0.03). There were also site differences (Heng County vs Xinjiang) in feeling anxious (OR=0.07; p=<0.01), not minding (OR=0.26; p=0.03), being bored (OR=0.25; p=0.01) and not finding the questions easy (OR=0.10; p=<0.01). Conclusions Quizzing during the informed consent process can be problematic for a minority of participants. These problems may be associated with the setting in which research takes place and educational level. Further research is needed to develop, test and implement alternative methods of ensuring comprehension of informed consent. Trial Registration clinicaltrials.gov number NCT00270257. (shrink)

L’Arbre du Bœuf ist darüber hinaus aufgrund einiger Motive besonders interessant, weil sie vermutlich aus archaischen Glaubensvorstellungen stammen: So ist die mystische „Reise zur Sonne“ ein bestimmendes Thema, welches seinen Ursprung im indoeuropäischen Mythos findet. Der Weltbaum als Axis Mundi und die Seelenbrücke sind Verbindungen zwischen dem Dies- (...) und Jenseits, die der Märchenheld ebenso wie der Schamane bei seiner ekstatischen Reise in die lichte Himmelswelt benutzt. Magische Tier- und Helferwesen treten im Zaubermärchen auf und sind integrale Bestandteile schamanistischer Glaubenswelten. Wenn im Märchen auf oder aus dem geopferten Ochsen als heiliges Tier der Weltbaum sprießt, so findet dieses Sujet Entsprechungen in urtümlichen Kosmogonien. Damit ideell verwandt ist vielleicht das Motiv vom „Tierhorn als Weltbaum“, welches sich in archaischen kosmologischen Vorstellungen findet und sich von da her womöglich ebenso in die Märchenwelten eingemischt hat. The folk tale L’Arbre du Bœuf of the type ATU 511 [One Eye, Two Eyes, Three Eyes] is according to P. Delarue and M.-L. Tenèze the only French fairy tale that belongs to the subtype AT 511 A [Little Red Ox]. In addition, L’Arbre du Bœuf is particularly interesting due to some of the motifs that probably stem from archaic beliefs: The mystical “journey to the sun” is a determining theme, which finds its origin in the Indo-European myth. The World Tree as Axis Mundi and the Soul Bridge are connections between this world and the hereafter which are harnessed by the fairy tale hero as well as the shaman in his ecstatic journey into the bright world of heaven. Magical animals and helping entities appear in the fairy tale and are fundamental parts of shamanistic beliefs. The World Tree as it sprouts on or out of the sacrificed and sacred ox finds its equivalent in ancient cosmogonies. Perhaps ideally related to this is the motif of the “animal horn as the World Tree”, which is present in archaic cosmological conceptions and has possibly interfered with the fairytale worlds as well. This is the text of The Lindley Lecture for 1996, given by T.M. Scanlon, an American philosopher.

[T. M. Scanlon] It is clearly impermissible to kill one person because his organs can be used to save five others who are in need of transplants. It has seemed to many that the explanation for this lies in the fact that in such cases we would be intending the death of the person whom we killed, or failed to save. What makes these actions impermissible, however, is not the agent's intention but rather the fact that the benefit envisaged does (...) not justify an exception to the prohibition against killing or the requirement to give aid. The difference between this explanation and one appealing to intention is easily overlooked if one fails to distinguish between the prospective use of a moral principle to guide action and its retrospective use to appraise the way an agent governed him or herself. Even if this explanation is accepted, however, it remains an open question whether and how an agent's intention may be relevant to the permissibility of actions in other cases. \\\ [Jonathan Dancy] My first four sections concentrate on the second section of Professor Scanlon's contribution, where he lays out his conception of moral principles and of the role they play in theory and practice. I will raise questions on the following issues: 1. Scanlon's initial introduction of the notion of a principle. 2. His rejection of the standard view that principles are concerned with the forbidding, permitting and requiring of actions. 3. His rejection of pro tanto conceptions of principles in favour of a conception of them as conclusive. 4. The resulting account of what it is for a principle to face and survive exceptions. Scanlon's discussion of these matters here both appeals to and is in some respects more detailed than the relevant section of his recent What We Owe to Each Other. The topic is interesting both for the role played by principles in Scanlon's present discussion of intention and permissibility, and more generally because of his account of wrongness: an act is wrong iff it is ruled out by principles that nobody could reasonably reject. The remainder of my contribution is concerned with the ostensible focus of IP, namely the relevance of agent-intentions to the permissibility of what is done. (shrink)

In this book, T. L. Short places the notorious difficulties of Peirce's important writings in a more productive light, arguing that he wrote philosophy as a scientist, by framing conjectures intended to be refined or superseded in the inquiries they initiate. He argues also that Peirce held that the methods and metaphysics of modern science are amended as inquiry progresses, making metaphysics a branch of empirical knowledge. Additionally, Short shows that Peirce's scientific work expanded empiricism on empirical grounds, grounding his (...) phenomenology and subverting the fact/value dichotomy, and that he understood statistical explanations in nineteenth-century science as reintroducing the idea of final causation, now made empirical. Those innovations underlie Peirce's late ideas of a normative science and of philosophy as a branch of science. Short's rich and original study shows us how to read Peirce's writings and why they are worth reading. (shrink)

This series will include monographs and collections of studies devoted to the investigation and exploration of knowledge, information, and data-processing systems of all kinds, no matter whether human, (other) animal, or machine. Its scope is intended to span the full range of interests from classical problems in the philosophy of mind and philosophical psychology through issues in cognitive psychology and sociobiology (concerning the mental capabilities of other species) to ideas related to artificial intelligence and computer science. While primary emphasis will (...) be placed upon theoretical, conceptual, and epistemological aspects of these problems and domains, empirical, experimental, and methodological studies will also appear from time to time. While most philosophers and psychologists tend to believe that the rise of cognitive psychology has occurred concomitant with the decline of operant psychology, Terry L. Smith contends that nothing could be further from the truth. He maintains that operant psychology has discovered (and continues to discover) reasonably well-confirmed causal principles of intentional behavior, which go beyond what cognitive psychology can provide, while cognitive psychology, in tum, has the potential to supply analyses (and explanations) that account for them. Smith thus advances a surprising but nonetheless illuminating perspective for appreciating the place of operant conditioning within the discipline of psychology in this rich and fascinating work. J. This essay argues that normative judgments, in general, and moral judgments, in particular, are "truth apt" and can be objects of belief. Other main claims are: judgments about reasons, if interpreted as true, do not have metaphysical implications that are incompatible with a scientific view of the world. Two kinds of normative claims should be distinguished: substantive claims about what reasons people have and structural claims about what attitudes people must have insofar as they are rational. Employing this distinction, the (...) practical significance of substantive normative judgments is explained, and critical analysis of expressivist and Kantian views on this question is offered. Cet adieu ne demeure-t-il pas l'impensé de la philosophie hégélienne ? This paper is a critical reading of Catherine Malabou's book on the future of Hegel. (Vrin, 1996) according to which the Hegelian notion of time goes much further beyond the meaning that had been suggested by Heidegger. There are in fact several times within the spéculative thought and such a wealth oftime may be termed plasticity (Plaztizitàt) : the surge of an event, the explosion of the unexpected, the future, or the idea of what is bound to corne. Whilst at the same time acknowledging the relevance and the newness of such an interprétation, Derrida questions whether one is ever able to perceive what is bound to corne. Isn't the true future an undialectizable and non plastic farewell to any kind of conception, anticipation and mourning process ? Many thinkers have said that a God whose existence is argued for metaphysically would have no religious significance even if he existed. This book examines the God or Absolute which emerges in various metaphysical systems and asks whether he, she, or it could figure in any genuinely religious outlook. The systems studied are those of Spinoza, Hegel, T. H. Green, F. H. Bradley (very briefly), Bernard Bosanquet, Josiah Royce, A. N. Whitehead, Charles Hartshorne. There is also a chapter on Kierkegaard (...) as the most important critic of metaphysical religion (especially Hegelian Christianity). The book ends with a statement of a form of absolute or pantheistic idealism espoused by the author and an indication of what religious significance it may have. (shrink)

Explains how a contractualist moral theory can explain the moral phenomena commonly called rights, although it does not appeal to the notion of a right as a basic element of moral thinking, or explain the difference between rights violations and wrongs of other kinds. Argues that the latter failure is not an important fault.

In response to comments on my book, Being Realistic about Reasons, by Justin Clarke-Doane, David Enoch and Tristram McPherson, and Gideon Rosen, I try to clarify my domain-based view of ontology, my understanding of the epistemology of normative judgments, and my interpretation of the phenomenon of supervenience.

W. B. Gallie's words about Peirce's cosmology—"the black sheep or white elephant of his philosophical progeny" (1952, p. 216)—have often been quoted, usually as a preface to giving a better account of the animal. That he attributed the view to 'contemporary philosophers' and did not assert it himself has usually been ignored. True, Gallie did argue that the "cosmology is a failure, and an inevitable failure" (p. 236), but he also said that Peirce himself "recognized … that his work in (...) this field was imperfect and sketchy" (p. 215), and he concluded the chapter, and his book, with an extremely sympathetic account of all that is nevertheless of enduring value in that failure. I am pleased by the degree of agreement about reasons between the three of us, which is much greater than I might have guessed. I have no objection whatever to the project of giving the kind of psychological description of deliberation about reasons that Gibbard proposes. I agree that “weighing X in favor of A isn’t mysterious,” but I do confess to some doubt about how a psychological description of this process of weighing “explains, indirectly, X’s counting in favor of (...) A in such circumstances.” If there is any disagreement between Gibbard and me on this point, I think it is over the degree to which such an explanation is to be expected. (shrink)

Two of his previous works are Nature: J^ An Environmental Cosmology, 1997, and The City: An Urban Cosmology, 1999 (both Albany: tfl SUNY Press). ^ 6. (...) The transliteration of ren as "authoritative person" is an egregious tour deforce, ^ leading to a somewhat inelegant result in English, as in the following examples: "Authoritative persons are content in being authoritative; wise persons flourish in it"; and "The Master said: "I have yet to meet people who are truly fond of authoritative conduct (ren)... And those who abhor behavior contrary to it, in becoming authoritative themselves, will not allow such conduct to attach itself to them" (cited from Grange, p. 29). Li (ritual propriety) is co-opted as a match for the Deweyan concept of experimental inquiry. Yi (sense of justice, outer righteousness, often combined with ren, which in combination constitute the two cardinal virtues of Confucian moral theory), and zhi (knowledge, wisdom) are similarly adopted to work in tandem with a model of an "aesthetic" populism. As a long time student of Native American political thought, I applaud this volume because it represents a departure from the attitudes that I encountered in the academy as a young Native American scholar a generation ago. I can remember as a young Associate Ptofessor being in the elevator of Bunche HaU at UCLA when a history colleague of mine turned to me and quizzed me about my interests in Native American history. When I stated that I was interested in Native American thought and particularly Native American political theory, the coUeague replied that they did not know that American Indians had any thoughts or inteUectual traditions. Needless to say, we have 863 ^ corne a long way since that conversation over twenty five years ago. I have ^ always taught undergraduate courses and graduate courses on the History of KH Native American Thought and I adopted this book for a graduate course of ^ mine when it first came out last year. I can say that it was well received by my ^ graduate students and it provided an excellent array of essays on the various areas of Native American philosophy. The work also demonstrates that Native American ideas can be examined within the context of the discipline of philosophy. This collection of essays by American Indian thinkers blends contemporary philosophies with traditional ideas and philosophical issues. Thus, philosophical questions relating to time, place, history, national communities, religion, law, science, the arts and ethics are all addressed. Moreover, the reader can compare Native American viewpoints on phenomenology, metaphysics, ethics, esthetics, epistemology, logic and science with the perspectives of Western philosophy on these topics. Lawrence Johnson advocates a major change in our attitude toward the nonhuman world. He argues that nonhuman animals, and ecosystems themselves, are morally significant beings with interests and rights. The author considers recent work in environmental ethics in the introduction and then presents his case with the utmost precision and clarity. Written in an attractive, nontechnical style, the book will be of particular interest to philosophers, environmentalists and ecologists.

The purpose of this study was to investigate nurses’ decisions about priorities in home-based nursing care. Qualitative research interviews were conducted with 17 nurses in home-based care. The interviews were analyzed and interpreted according to a hermeneutic methodology. Nurses describe clinical priorities in home-based care as rationing care to mind the gap between an extensive workload and staff shortages. By organizing home-based care according to tight time schedules, the nurses’ are able to provide care for as many patients as possible. (...) Furthermore, legal norms set boundaries for clinical priority decisions, resulting in marginalized care. Hence, rationing care jeopardizes important values in the nurse-patient relationship, in particular the value of individualized and inclusive nursing care. The findings are highly relevant for clinical practice, since they have major implications for provision of nursing care. They revive debates about the protection of values and standards of care, and nurses’ role and responsibility when resources are limited. (shrink)

It is a particular pleasure to be able to participate in this symposium in honor of Amartya Sen. We agree on a wide range of topics, but I will focus here on an area of relative disagreement. Sen is much more attracted to consequentialism than I am, and the main topic of my paper will be the particular version of consequentialism that he has articulated and the reasons why he is drawn to this view.

In a previous paper (Duncan, T.L., Semura, J.S. in Entropy 6:21, 2004) we considered the question, “What underlying property of nature is responsible for the second law?” A simple answer can be stated in terms of information: The fundamental loss of information gives rise to the second law. This line of thinking highlights the existence of two independent but coupled sets of laws: Information dynamics and energy dynamics. The distinction helps shed light on certain foundational questions in statistical mechanics. For (...) example, the confusion surrounding previous “derivations” of the second law from energy dynamics can be resolved by noting that such derivations incorporate one or more assumptions that correspond to the loss of information. In this paper we further develop and explore the perspective in which the second law is fundamentally a law of information dynamics. (shrink)
